Three generations are going …

Nancy Carver visits with her mom and daughter.  Nancy’s mom irrigates her lawn and beautiful garden from the Water Right allotment out of Shackleford Creek in Quartz Valley.

Nancy and her family will be going to the RESTORE  HONOR WATER RALLY on Aug. 28, 2010 in Yreka, CA.  Time is 5 p.m.

Like-minded folks that want to learn how to stand up to government agencies, which are attempting to destroy their Water and Property Rights, are invited to attend the Scott Valley Protect Our Water Rally.

This is Shackleford Creek near the legal diversion that Nancy uses to obtain her legal Water Right.  On June 1, 2010, it was roaring with a huge amount of volume of water.

Today on Aug. 25th, Nancy said the snow pack in the mountains has melted and the water in the creek is so low, that the creek water level is below the level of the cement diversion.  So, Nancy can no longer irrigate her fields.

Hum, guess we’ll have to ask how her mom irrigates her garden, lawn and flowers.

Jim and Virginia McFadden are going to the RESTORE  HONOR  WATER  RALLY on Aug. 28, 2010 at the Siskiyou Golden Fairgrounds in Yreka, CA.

It starts at 5 p.m. with sharing of information by groups threatened by government agencies regarding water issues.

Anyone interested in learning how to stand up to out-of-control government agencies are invited to attend.

The Water Rally is sponsored by Scott Valley Protect Our Water.

Jim and Virginia are leaders of the Scott Valley Protect Our Water and have chosen to say “NO” to the California Department of Fish and Game and the Siskiyou Resource Conservation District.  Both agencies are developing Permits for “normal” agricultural activities that will drastically hurt the viability of their business by reducing the amount of water they can use.

But the water they use to irrigate their fields is legal and cannot be undermined by the state agency, because the water is a legal allotment through a Water Right.

When Jim received a certified letter last spring from the California Department of Fish and Game that “threatened” him into signing a Notice of Intent and paying $100 to the Siskiyou Resource Conservation District, he said “NO,” he would not be bullied.

The letter felt like “extortion,” Jim recalls, because of the huge fines and imprisonment that was threatened by the state agency, if he did not sign the Notice of Intent to sign up.

Jim believes along with others supporting Protect Our Water that the regulations are outrageous.

These regulations will reduce the amount of water a legal Water Right holder can use by expanding two Permits.

One of these permits is the streambed alteration Permit called 1602.  In past circumstances, a 1600 permit was only needed to use an excavator or bulldozer to do streambed alteration, when building a large project such as a bridge, road or culvert.

This Permit is being re-written by the California Department of Fish and Game and the Siskiyou Resource Conservation District and now claims that diverting water is a streambed alteration — even though a machine or even a shovel does not touch the streambed.

Scott Valley POW believes this is an illegal expansion of power by the state agency and the local RCD. Over the past 20 years, the Siskiyou RCD has  aided farmers and ranchers in obtaining government help to conserve their property.

Now the Siskiyou RCD  has become a policing agency.

The original intent of a 2nd Permit, which is still being written, was to protect a landowner from prosecution, if he accidentally injured, harassed or harmed an endangered specie. The Permit is referred to as an Incidental Take Permit or ITP.

The coho salmon is listed with the California Endangered Species Act and so receive state protection.

The new ITP Permit will now harm, harass or injure the Water Right holder by demanding the Water Right holder leave more water in the stream.  This will hurt his business by taking away his irrigation water.

A Water Right is a Property Right and is protected under the U.S. and California Constitutions.  We must stand for our RIGHTS or the bureaucrats will take them away.

Siskiyou County Water Users Association pushes Klamath Dams Removal to Siskiyou ballot

Siskiyou County citizens will vote on removal of Klamath Dams in Nov. 2, 2010 election.

It will only be an “advisory” election, but Siskiyou County Water Users Association, SCWUA, wanted to know what the voting public thinks of the removal of four dams in the Klamath River by the federal government. The SCWUA believes the removal will destroy agriculture and the economy of Siskiyou County as well as the fish runs of endangered coho salmon.

SCWUA asked the Siskiyou County Board of Supervisors earlier this month to place the Klamath River Dam Removal issue on the ballot. After some re-working of the ballot to meet State space specifications, Siskiyou County Clerk Colleen Setzer was able to put the controversial dam removal subject on the ballot. It will be known as Measure G.

Frank Tallerico, president of the newly organized Siskiyou County Water Users Association, and the SCWUA board, worked diligently and quickly in late-July to meet requirements in getting the issue on the ballot.

Tallerico said the group made the language very simple for the ballot. It is easy to understand the question and vote “yes” or “no”.

Measure G will specifically ask voters “Should the Klamath River dams of Iron Gate, Copco 1, and Copco 2 and associated hydroelectric facilities be removed?” as part of the Klamath Hydroelectric Settlement Agreement.

The KYSAgreement lays out a plan for the potential removal of the three dams in California and the JC Boyle Dam in Oregon.

Arguments are being submitted that will urge a “yes” vote and “no” vote, which will also be on the ballot for the voter to read.

Jess and Ardeth Bigham are going …

Jess keeps his garden irrigated through his legal Water Right allotment and it is producing well this year as the above photo proves.

This Saturday, Jess will take his wife, Ardeth, to the Restore Honor Water Rally at the Siskiyou Golden Fairgrounds in Yreka, California. Date is Aug. 28, 2010.

It starts at 5 p.m. with networking and info-sharing of groups throughout Siskiyou County that are fighting to protect their right to water and right to land.

THIS IS A VERY IMPORTANT MESSAGE FROM A RANCHER HERE IN THE SCOTT VALLEY, AS YOU WILL SEE IN THE LETTER IT IS A BEGINNING AND WILL TAKE PLACE ALL OVER THE STATE —

Dear Friends and Neighbors:
Though this may fall on a few deaf ears — or on some who simply won’t believe the full ramifications of this proposed SB 565, the coming assault is real and it is beginning to happen all over California.

Actually, THIS IS ALREADY HAPPENING WITH US (specifically the Jenners so far in Scott Valley)….we’ve had 3 visits in 2 weeks from Fish & Game deputies/wardens (all decked out in their bullet-proof vests and sidearms!)…..and Water Quality….. about giving up our Water Rights via controversial 1600 agreements — which will cost us thousands of dollars whether we submit to their proposals one way or the other — over rights we already possess as part of our land/property rights.  It’s more complicated than this, of course, but either way, the choice is absurd and in our minds, unconstitutional (and so says the water attorney).

This is all so incredible…..Doug has hardly slept in 2 weeks and we have hired this water attorney who says hang tough, DON’T submit …but now,  this bill, will simply be ANOTHER way for the state government to move in and “take” water.  We’ve already faced a similar array of “permits” in the last 5 years while attempting to “clean” out gravel that has washed downstream in a creek that crosses our property — and so far, we’ve paid out OVER $30,000 in permits to SIX agencies (duplicating paperwork), while NO ONE from even one of these agencies has ever come out to “see” anything — and STILL we have not gotten PERMISSION  to move the gravel.
Ironic, really, when the last time we did rock work, the local Resource Board came out and NOTED that there were 55 NEW spawning holes in OUR portion of the creek (where the rock had been moved/cleaned out), while the creek was almost “dead” above our property line! Wouldn’t someone — somewhere — think, YES, this is a GOOD thing. Instead we are constantly being called out to defend what we actually have as a responsibility and right to do, if only for flood control and to prevent further bank erosion.
Like the Klamath Basin farmers who lost ALL their water several years ago (and 3 small towns dried up as well), we will be put on the chopping block via a law like this!  The fines are massive and the implications incredible for ALL CALIFORNIANS! Diversions are first, and wells and ground water will be second, and it specifically targets farmers and ranchers, but it will come to be more than that eventually. Sadly, however, many farmers will not be able to survive this assault and we may not either — although we’re going to fight it all the way. I have to believe that Orwell’s 1984 is coming to pass; the incredible ability to use language and turn reality inside out is amazing. Truly, BIG Brother is moving in on farmers and ranchers…..but we won’t be the only target, merely the first.
Please, please, please, please take action and urge your assemblymen and women to OPPOSE SB 565 (it will mean death for many in California — except, of course, for maybe a few REALLY “big” guys!).
And if you will, please forward this to your friends and neighbors, too. I am not asking anyone to take a stand in regards to individuals or parties, but I AM asking your support on behalf of farmers and ranchers all over this state who are barely making it now….and if we “go down,” it will dramatically affect all consumers and eventually all communities. It’s a travesty and a sham.
